Terms of service

This is the agreement between «not yet set»and the gym using LUDUZO. It is not the agreement between a gym and its own members — that is the gym's own business, and nothing here changes it.

The account

One person opens the account and is responsible for it. They may add staff, and remain responsible for what those staff do with it.
Sign-in details are not to be shared. Each person who needs access gets their own.
You must be entitled to record the information you put in, and to have agreed it with the people it is about.

Your data is yours

The gym's records belong to the gym. We hold them to run the service and for nothing else — they are not sold, not shared, not used to train anything, and not looked at except when you ask us to help with a problem.

You can export your members at any time, from inside the product, without asking. If you leave, you take your data with you.

What happens when you stop

You can close the account whenever you want.
Export first — after the account closes the records are deleted.
Encrypted backups age out after 14 days, so a short window exists between deletion and the last backup expiring.

What is promised, and what is not

Plainly: LUDUZO runs on a single dedicated server in Nuremberg, Germany, operated by Hetzner Online GmbH. There is no second machine standing by. If that server fails, the service is unavailable until it is rebuilt from backup, and that takes hours rather than minutes.

So no uptime figure is offered here, because one would be invented. What is offered instead is the truth about the arrangement, and a commitment that the backups are real — they are restored and verified automatically every day, not merely written.

The service is provided as it is. Maintenance happens, occasionally at short notice when it is a security fix.

Payment

Fees, if any, are whatever has been agreed with you in writing. LUDUZO does not currently take card payments of its own, and does not process your members' card payments — money your members pay you is recorded in the product, not moved by it.

What you may not do

Use it to store information you have no right to hold.
Attempt to reach another gym's data, or test whether you can, without written permission.
Resell access, or run someone else's gym on your account without telling us.

Security research is welcome, but tell us before you start and never use a real gym's data to do it. Write to «not yet set».

Ending it

Either side can end this with reasonable notice. We would only end it without notice for something serious — unlawful use, or an attempt on another gym's data. In that case you still get your export.

Liability

Nothing here limits liability where the law does not allow it to be limited. Beyond that, and to the extent the law permits, liability is limited to the fees paid in the twelve months before the claim.
